This document sets out the Terms and Conditions you need to be aware of when using this website or purchasing from me. Please take a moment to read it, as it sets out the terms of our relationship so that we may both benefit from clear boundaries and knowing what to expect from each other.

When you visit this website, use my services or purchase my products you agree that you are over the age of 18 and willing to be bound by these Terms and Conditions. If you don’t agree, you should not continue to visit this website or purchase from me.

Disclaimer for Services and/or Products

There are a number of ways you may choose to work with me that are available to purchase or book through my website. The terms and conditions in this document apply to all of my services and products unless alternative terms are explicitly provided to you.

I offer:

·       Naturopathic consultations where a wholistic approach is taken using questioning and sometimes physical examination (eyes, tongue, nails, skin observations) to establish where your health is at and how we can work together to improve your health and general wellbeing.

·       The Metabolic Balance® program where it is identified inside a naturopathic consultation if you are a good candidate for the program. It is a 12-week personalised nutrition program with 7 consultations to support you through the process.

My intention in offering these services / products is using a wholistic approach to support you to achieve your health goals and improve your general wellbeing so you can live a life you love.

Why work with me?

QUALIFICATIONS

I have completed formal studies to become a Naturopath including an Advanced Diploma of Naturopathy and Bachelor of Health Science (Naturopathy) as well as post graduate studies becoming a Metabolic Balance® practitioner.

PROVIDER RESPONSIBILITY

I am constantly updating my skills and training by completing a minimum of 20 hours of continuing professional education (CPE) each year. I am committed to best practice principles, taking all reasonable care and due diligence by always keeping the clients best interest front and centre while providing my services.

Your Responsibility

CONSUMER RESPONSIBILITY

When working with me you agree to always disclose the truth about your health status (new medical diagnosis, pregnancy, if you are trying to conceive), medications (both prescribed and over the counter), any changes to your health status and/or medications, use of recreational drugs and notify me of any allergies and intolerances. You also agree to take personal responsibility for your health and wellbeing, as the saying goes “nothing changes if nothing changes” so if you make none of the suggested changes you can expect nothing to change in your health status.

IMPORTANT INFORMATION

It is important for you to take ownership for your health journey and to remember to have patience, as well as allowing time in your schedule to invest in your health to create change. It generally takes time for your health to deteriorate to get to a point where you decide to do something about it. There are no magic quick fixes or magic supplements and as it’s taken time for your health or wellbeing to deteriorate you can’t expect to be done after one session with me, particularly if you are seeking assistance for a chronic or long-term condition. You may be asked to make diet and/or lifestyle changes and it’s important to understand that a supplement or herb can not create lasting change on its own. If you don’t make any change or put in minimal effort then there may be little to no change in your health status.

SPECIFIC INSTRUCTIONS

You will need to complete the intake and consent form prior to your initial appointment. It is important to be open and honest while working with me, at times you may feel embarrassed discussing your health issues or body functions, but your honesty and openness helps me to provide the best and most personalised advice for you. It is equally important to let me know of any changes to your health such as new diagnosis, new medications or you fall pregnant.

It is important to not share your prescription (supplements and/or herbal medicines) or treatment plan with anyone else as this is advice that has been tailored specifically to you and your individual circumstances. These are not to be shared with anyone else as even if they have the same condition as you, they have their own individual biochemistry and genetics, and the prescription for you may not suit their specific needs and may possibly cause harm.

RISKS

Adverse Reactions: Please do not self-prescribe supplements as they may have unintended interactions and/or may not be suited to your unique biology. If you have any concerns or are experiencing a reaction, please immediately stop taking all supplements, immediately seek medical attention and let me know of any reactions as soon as possible.

Changes to health status: notify me if you receive a new diagnosis and/or are put on a new medication so I can double check that what we are doing won't interact and have negative impacts.

Pregnancy: notify me as soon as you find out you are pregnant as not all supplements and/or herbs are safe to take during pregnancy. If you are trying to conceive you should also tell me so I can make pregnancy safe recommendations and support you on the conception journey.

Trigger warning: as we deal with our health, often there have been emotions associated with our health journey, and occasionally deep traumas may begin to resurface as we support the body back to health. I am not a trained counsellor but will refer you on to other professionals for assistance. It takes a village/team to support us on our health journey.

LIMITATIONS

While I am a qualified Naturopath I am not a medical professional and can not make diagnosis of disease. I will refer you to your medical practitioner when indicated. I am also not a mental health professional and will refer you for further support when indicated.

PROFESSIONAL ADVICE

It is important to get clearance from you doctor before making major changes to your lifestyle. You will also need to monitor your own mental and emotional wellbeing. If any concerns arise, I strongly recommend you seek advice from a mental health professional.

SUITABILITY

People who are living rurally or remotely who want to take control of their health and are willing to put in the work to create sustainable change.

UNSUITABILITY

If you are not willing to accept responsibility for your health problems and make changes within your control like your diet and/or lifestyle you might not be a good fit for this work.

Limitation of Liability

I take my obligations under Australian Consumer Law seriously and will do my best to address any issues that arise. However, even if there is a major problem, my liability is strictly limited to:

- replacing the goods or providing the services again; or

-if I am unable to do so within a reasonable time, paying the cost of having the relevant goods or services supplied to you again.

INVITATION TO DISCUSS PROBLEM

If you feel that there is any problem with your purchase, please let me know within 72 hours. I am keen to understand what has gone wrong if you are unhappy so that I can address your concerns and try to find a mutually acceptable solution.

WAIVER

I do not make any guarantees or warranties about the accuracy of any material displayed on this website, with the exception of any non-excludable consumer guarantees and other consumer protection provisions set out in the Australian Consumer Law. I am human and errors creep in despite the best of intentions. If you see something that doesn’t seem right, please let me know.

While I make all reasonable efforts to ensure that this website and my services and products meet with the highest standards of best practice, if something does go wrong that is not a direct result of my negligence, misrepresentation or deliberate fault, you agree that, to the fullest extent permitted by law, I will not be liable for any loss or damage arising out of or related to my website, any products or services purchased through it, or any material posted on it, irrespective of whether such damages were foreseeable, and regardless of the nature of the claim.

You take full responsibility for your implementation of any suggestions that I may make while providing my services. You understand that my advice is limited to providing you with options for your consideration, and that you are solely responsible for any actions that you choose.

If you are a student participating in any training I may offer, course content may be printed or downloaded to a local hard disk strictly for your personal and non-commercial use. Course content contains my trade secrets that are offered exclusively to students. Payment Terms

All payments made through this website are processed using Square.

Face to face consultations have the option of cash, card payments via Square or bank transfer.

Consultations booked online require pre-payment at the time of booking via Square.

For the Metabolic Balance® program EFT bank transfer is preferred but I will also accept card payments via Square.

SECURITY POLICY

I do not have access to your account or credit/debit card details. Any financial information you enter is stored under Square's security policy: https://squareup.com/au/en/security.

PAYMENT TERMS

Payment is due at the end of the naturopathic consultation for services rendered and supplements supplied.

The Metabolic Balance® program requires full payment prior to our initial Metabolic Balance® appointment. This will be invoiced after we have identified you are a good candidate for the program during a regular naturopathic consultation. Payment is due within 14 days of the date on the invoice. The program will not commence until payment is received. If you are unable to pay in full prior to commencing the program please talk to me about arranging a payment plan.

PAYMENT PLANS

Payment plans are offered for your convenience only on the Metabolic Balance® program, so you can spread your payment out over time.

Delivery and Shipping

DELIVERY

Face to face consultations will take place at Corkwood Collective, 8009 Ragonesi Road, Ross NT 0870.

Telehealth consultations are conducted via zoom. The link for zoom, and instructions on how to download and install are sent out in both the initial confirmation of the appointment and in the reminder of your appointment email. Please ensure you have a private location where you won't be disturbed as we will be discussing sensitive matters that you may not want other people overhearing, or don't want to be interrupted and lose your train of thought. If the internet drops out or is not working for either party, the consultation will be either conducted via phone if possible (except for an initial consultation which will be rescheduled), or rescheduled to the earliest possible next available appointment that suits both parties.

The intake and consent form needs to be filled out prior to commencing my services.

SHIPPING

Shipping of Metabolic Balance® plans to clients not located in Alice Springs will be included in the program costs.

For clients not located in Alice Springs, any supplement and/or herbal medicine prescriptions will be dispensed via a Third-Party Supplier. I provide you with a script to a third-party supplier and if you have any issues regarding delivery or quality control this needs to be addressed directly with the third-party supplier.

Appointment Policies

My goal is to provide quality care to all my clients in a timely manner. No-shows, late arrivals, and cancellations inconvenience not only myself, but my other clients as well. Please be aware of my policy regarding missed appointments.

If you need to cancel or reschedule your appointment, please call me on 0457306634 between the hours of 9am to 5pm. If necessary, you may leave a detailed voicemail message. I will return your call as soon as possible.

A cancellation is considered late when the appointment is cancelled less than 24 hours before the appointed time. A no-show is when a client misses an appointment without cancelling. In either case, you the client will be charged a $50 missed appointment fee.

I know your time is valuable, and mine is too. Out of respect I ask that you give at least 24 hours’ notice to reschedule or cancel an appointment. Missed appointments, or appointments cancelled with less than 24 hours’ notice will incur a fee of $50.

If you are more than 10 minutes late for your appointment, I may not be able to accommodate you. In this case, the same cancellation fee will apply. I will do my very best to reschedule your service for another time that is convenient to you.

Refund Policy

CHANGE OF MIND

I do not offer a refund if you change your mind about your purchase. However, I will happily meet with you to discuss your concerns and attempt to negotiate a win/win solution. The meeting will be arranged at a mutually agreed time and will take place either face to face, via zoom or over the phone. 15 minutes will be allocated for this meeting and you must let me know of a change of mind within 72 hours of purchase.

ORDER FULFILMENT POLICY

I do not offer backorders for stock. If I am out of stock of an item I will write a script to be filled by a third party dispensary which ships the order direct to the client. I only accept payment for stock I have on hand.

REPLACEMENT PRODUCTS

Photos of proof of damage are to be provided if items I have shipped become damaged. A replacement will be sent at no extra cost to the customer.

The third party dispensary’s I use have their own policies and are to be contacted directly if there is a problem.

Respectful Communication

COMMENTS POLICY

I reserve the right to delete any comments on my website or social media accounts that are rude, offensive or that which I deem to be unacceptable. Please keep it polite and play nicely.

RESPONSIBLE ENGAGEMENT

Please contact me directly with any feedback so that if there is an issue, we have the ability to work together to resolve the issue in a win-win manner before you publicly post negative feedback.

Dispute Resolution & Jurisdiction

NEGOTIATION

If you have any concerns, issues or complaint arising out of your use of this website, my services or these terms and conditions, you agree to communicate with me with the intention of making a genuine effort to seek a win/win solution and trying to resolve the dispute in good faith through negotiation and discussion. Please email me at hello@elizabarwick.com.au and expect a response within 2 business days.

MEDIATION

“We” below refers to everyone involved in the dispute.

If the dispute cannot be resolved by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an independent accredited mediator, seeking mediation online or by telephone if we are not both geographically located within 100kms of each other.

The mediator is to be appointed by agreement between us or, failing agreement within 21 days of the negotiation period ending, the person initiating the dispute will seek the appointment of a dispute resolution professional by the President of the Law Society of the Northern Territory or similar neutral authority.

We agree to share all the costs of mediation equally between us.

We agree that neither of us will commence legal action until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.

If we are unable to resolve a dispute by negotiation and discussion, you may access the complaints procedure offered by Australian Natural Therapists Association (ANTA) here: https://www.australiannaturaltherapistsassociation.com.au/about/complaints-process/.

NON-DISPARAGEMENT

If a dispute arises, we all agree that we will not engage in any public discussion about the issues, we will behave politely towards each other, and we will avoid any conduct or communication which might reasonable be expected to unreasonably interfere with any other person’s business or personal interests.

JURISDICTION

This agreement is subject to the governing law of the Northern Territory. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of the Northern Territory, and the Commonwealth of Australia, will have exclusive jurisdiction.
